Why HP Customers Might Have Been Mis-Sold
Between April 2007 and November 2024, many Hire Purchase agreements may have been mis-sold without the customer ever realising. The issue lies with a widespread practice known as discretionary commission arrangements (DCAs), in which car dealers and brokers were allowed to adjust the interest rate offered to a customer to increase their own commissions. In many cases, this incentive or how it works was never disclosed to the consumer. The Financial Conduct Authority (FCA) has called this practice unfair, and the scale of it has triggered one of the biggest mis-selling scandals since PPI.
In August 2025, the Supreme Court ruled that other agreements may also have been mis-sold, depending on the circumstances surrounding the commission, in particular the size of the fee. The court decided that consumers who paid non-discretionary commission may have been mis-sold if it was deemed too excessive.
The FCA will start a redress scheme in early 2026 to compensate consumers who have been mis-sold.
You may have been mis-sold your HP agreement if:
- You weren’t told about any commission being paid to the dealer or broker.
- You weren’t offered the most competitive rate available.
- The agreement was pushed through with little to no affordability checks.
